What is a Lasting Power of Attorney?

What is the difference between the two types of LPA?

The Property and Financial Affairs LPA covers your money, property and bills. The Health and Welfare LPA covers your medical care, living arrangements and daily wellbeing.

What happened to the Enduring Power of Attorney (EPA)?

Enduring Powers of Attorney were replaced by Lasting Powers of Attorney in October 2007. If you already have an EPA made before that date, it is still valid for financial matters but cannot cover health or welfare decisions. We can review your existing EPA and advise whether creating an LPA would offer better protection.

At what age should I make an LPA?

There is no minimum age beyond 18, and it is sensible to create an LPA at any stage of adult life. Many younger adults arrange one before travelling, working overseas or in situations where someone else may need to act temporarily on their behalf. Having an LPA in place is not only for later life; it is about being prepared for the unexpected.

Can I make an LPA if I am already unwell?

You can make an LPA as long as you have the mental capacity to understand what it means. It is best to arrange it early, while you are well, to avoid any future complications.

Who can be my attorney?

You can choose anyone over 18 whom you trust to act in your best interests. This could be a family member, friend or professional representative. We can help you decide who is most suitable.

Does marriage or divorce affect an LPA?

Yes, it can. If you marry or form a civil partnership, any existing LPA naming your partner as attorney may remain valid, but it is advisable to review it. If you divorce or legally separate, your former spouse or partner is usually removed as attorney automatically, unless stated otherwise. We can help you check and update your documents to reflect any changes in your circumstances.

When does an LPA take effect?

A Property and Financial Affairs LPA can be used as soon as it is registered if you allow it. A Health and Welfare LPA only takes effect if you lose the ability to make decisions yourself.

How long does it take to register an LPA?

Once the forms are submitted, registration with the Office of the Public Guardian typically takes around 8 to 10 weeks. We can track progress and keep you informed throughout.

Can I change or cancel my LPA?

Yes. As long as you still have mental capacity, you can cancel or amend your LPA at any time. We can help with replacement or updated versions if needed.
