In fact, once your child turns 18, they are legally an adult and you, as their parent or guardian, no longer have the right to make decisions on their behalf, even in an emergency.

What Can an LPA Help With?

A Lasting Power of Attorney allows a trusted person—usually a parent or close family member—to make decisions or take action on someone’s behalf if they become unable to do so themselves.

There are two types of LPA:

  • Health and Welfare LPA – covers decisions about medical treatment, care arrangements, and life-sustaining care.
  • Property and Financial Affairs LPA – allows someone to manage bank accounts, deal with insurance, or handle financial obligations such as rent, student loans, or travel bookings.

Having both in place provides essential peace of mind should something unforeseen happen while your child is overseas.

Real-World Scenarios

Consider this: your child is backpacking in South America, is involved in an accident, and is temporarily unconscious. Without an LPA, you may not be able to speak to the hospital or access their insurance details. Similarly, if they lose access to their bank account or face an issue with stolen documents, you’ll be powerless to help without the right legal authority.

These aren’t scare stories—they’re real-world situations that many families have found themselves in, with avoidable stress and delay as a result.
